Acceptable Use Policy

This policy is part of the Terms of Service. Breach can result in immediate suspension or termination of your account without refund, and where the law requires it, a referral to law-enforcement authorities.
Absolutely prohibited
You must not upload, generate, store, share, or attempt to do any of the following through Swapmark:
- Child sexual abuse material (CSAM) or any content that sexualises minors. We have a zero-tolerance policy. We report apparent CSAM to the appropriate authorities and preserve evidence.
- Content you do not own or are not licensed to upload. Stock images you have not licensed, screenshots of someone else's work, content scraped from the web, or a client's IP without authorisation.
- Material that infringes third-party trademarks, copyrights, designs, patents, trade secrets, rights of publicity, or privacy rights.
- Identity theft / impersonation— uploading another person's photo or likeness to misrepresent who they are or their views.
- Non-consensual intimate imagery (NCII), including deepfake nudes of any real person.
- Content that promotes terrorism, mass violence, or organised crime, or that incites violence against any person or group.
- Hate speech — content attacking people on the basis of race, ethnicity, religion, gender, gender identity, sexual orientation, disability, or similar protected characteristics.
- Harassment, bullying, threats, or doxxing of any individual.
- Fraud, scams, phishing, or content designed to deceive for financial gain.
- Malware, exploits, or content engineered to compromise our infrastructure or other users' devices.
- Content that violates export-control or sanctions law.
- Personal data of other people that you do not have a lawful basis to process.
Service abuse
You must not:
- circumvent or attempt to circumvent rate limits, plan caps, paywalls, or storage quotas;
- automate access in a way that materially burdens the Service, except via APIs or features we explicitly publish;
- reverse-engineer, decompile, or attempt to extract source code or non-public model weights from the Service;
- resell or sublicense access to the Service without our written agreement;
- use the Service to build a competing product;
- share account credentials with anyone outside your organisation.
AI generation specifics
When using AI variation generation, in addition to the above you must not:
- attempt to generate any content prohibited above;
- prompt the model to produce sexually explicit imagery, even of adults, unless we explicitly enable that for your account (we do not currently);
- prompt the model to generate the likeness of an identifiable real person without their consent;
- deliberately probe for outputs that would breach the AI provider's own usage policies.
